Terms of Use
The short version.
- This is a personal art project by Alex Jay. It is not a charity, a business, or a financial investment.
- A gift is a voluntary gift to me. You get nothing in return except a thank-you. There are no prizes, raffles or contests.
- Gifts are non-refundable. If your name or photo isn't appropriate, or a photo doesn't meet the portrait standards, I may leave it out, the gift stays a gift, and I won't contact you about it. If there was an honest mistake, tell me and I may refund you.
- If you send a photo, you're giving me permission to use it in the project, and it must be a photo of you.
- When the project reaches one million people, the finished video and collage will be uploaded to this site and to YouTube, free for anyone to watch and download. Your photo is public earlier than that: once I approve it, it can appear on the site's wall and collage and in the weekly videos, and anyone can save a copy. I can't take back copies people have saved.
1. Who I am
ibeg4bucks.com ("the site") is run by Alex Jay, an individual, California, USA ("I", "me"). Contact: through the contact form. By using the site or sending a gift you agree to these terms and to the Privacy Policy. If you don't agree, please don't use the site.
2. What this is
The project asks one million people to each give $1 and send a profile picture, to find out whether strangers will say yes. Every approved picture becomes a frame in a weekly video and a tile in a collage. When the project reaches one million people, I'll upload the finished video and collage to this site and to YouTube, free for anyone to watch and download. The project runs until one million people have given, with no deadline. The goal is an aim, not a promise: I can't guarantee it will be reached. If I become unable to continue, the project will stop taking gifts and I'll have arranged for someone I trust to wind it down, which may include publishing the video as it stands or deleting the photos.
3. Gifts
- Gifts are voluntary and go to me personally. They are not donations to a charity or nonprofit, and they are not tax-deductible. They may be taxable income to me.
- A gift buys no goods, services, shares, rewards or prizes. Nobody wins anything. A spot on the wall or in the video is a thank-you, not something you purchase.
- I intend to put the money toward my education, my living costs and what comes next, including more projects like this one. This is my intention and not a legal promise. A gift doesn't give you ownership of, or a claim on, the money or anything I do with it.
- You must be at least 18, and you must be the rightful owner of the card or account you use.
- Payments are handled by Stripe and are subject to Stripe's terms. If a payment is disputed, I may share the details needed to resolve it.
4. Refunds
Gifts are non-refundable. If your name or photo isn't appropriate (for example, it's offensive, isn't a photo of you, or shows someone else), I'll leave it out and the gift stays a gift. If there was an honest mistake, such as a duplicate charge or the wrong photo, tell me and I may refund you at my discretion, usually within 7 days.
5. Your photo, name and message
If you send them, you confirm and agree that:
- The photo is of you, you took it or have the right to share it, and nobody else is identifiable in it. It shows nobody under 18.
- You give me a free, non-exclusive, worldwide permission to use, copy, resize and combine your name, message and photo in this project: the weekly video, the collage, and the finished video and collage that I'll upload to this site and to YouTube for anyone to watch and download, and posts or press that show the project.
- You can ask me to stop showing you at any time, and I'll leave you out of anything I make from then on. Once your photo has appeared on the site, in the collage or in a weekly or finished video, anyone can save copies, and I can't recall them. Please only send a photo you're comfortable having public for good.
- The site shows how to take your portrait. If your photo doesn't meet those standards, I may decide not to use it, and I won't contact you if I don't. That isn't a reason for a refund, and your gift stays a gift.
- I review everything before it appears and can decline or remove anything, for any reason. No hate, nudity, harassment, ads, or anything illegal or misleading.
6. Using the site
Don't attack, overload or try to break into the site or its payment flow, don't submit things you have no right to submit, and don't use the site for anything unlawful. I may block anyone who does.
7. No promises about the site or the video
The first video comes out when 100 faces are in. After that I'll try to publish a new one every week, but I can't promise exact timing or that the site will always be available. The site and everything on it is provided "as is".
8. Limits on responsibility
To the fullest extent the law allows, I'm not liable for indirect or consequential losses arising from your use of the site, and my total liability for any claim relating to the site is limited to the amount of the gift you made. Nothing here limits any right you have by law that can't be limited, such as for fraud or my own gross negligence.
9. Changes
I may update these terms. The date at the top shows the latest version. A change doesn't affect a gift you've already made.
10. Governing law
These terms are governed by the laws of California, USA, and disputes are for the courts there, except where your local law gives you the right to go elsewhere.
